When do we require expert testimony? When we require an opinion about something that is beyond the range of ordinary experience. Most medical malpractice cases are an example. The standard of care is usually established by the medical profession.

But in a garden variety slip and fall case (no pun intended), the standard of care is established by the courts: the store owner must remove the hazard when it could had reasonable time to discover it and remove it.
